Terms of Service.
1. Acceptance
1.1 By submitting a device to Refurb Global (Pty) Ltd for repair or service, the customer ("you" or "Customer") agrees to these Repair Terms and Conditions ("Repair Terms").
1.2 These Repair Terms constitute a legally binding agreement between you and Refurb Global (Pty) Ltd ("Company," "we," "us," or "our").
1.3 If you are submitting a device on behalf of a company or organization, you represent that you have authority to bind that entity to these terms.
1.4 We reserve the right to refuse service to anyone for any reason at any time.
2. Diagnostics & Quotations
2.1 Diagnostic Assessment
Devices may be subject to a diagnostic assessment to determine the nature and extent of repairs required. Our technicians will examine the device and identify faults.
2.2 Diagnostic Fees
Important: Diagnostic fees are non-refundable. This fee covers the time and expertise required to assess your device, regardless of whether you proceed with the repair.
The diagnostic fee will be communicated to you before assessment begins. This fee may be waived or applied toward the final repair cost at our discretion.
2.3 Quotations
- Quotations are valid for seven (7) calendar days from the date of issue
- After 7 days, the quotation expires and a new assessment may be required
- All quoted prices are in South African Rand (ZAR) and include VAT unless otherwise stated
- Quotations are estimates based on visible faults; additional issues discovered during repair may result in revised pricing
3. Repairs & Authorisation
3.1 Repair Authorisation
Repairs will only proceed upon explicit customer approval. We will contact you with the diagnostic results and quotation, and await your confirmation before commencing work.
3.2 Additional Faults
If additional faults are discovered during the repair process that were not identified in the initial diagnosis:
- We will suspend work and contact you immediately
- A revised quotation will be provided for the additional repairs
- You may choose to approve the additional work or proceed with the original scope only
- If you decline additional repairs, we will reassemble the device with the original fault(s) still present where possible
3.3 Parts Availability
Note: The Company is not responsible for delays caused by unavailable parts. We will communicate expected lead times and keep you updated on parts procurement status.
If specific parts are required:
- We will source quality replacement parts from reputable suppliers
- Original Equipment Manufacturer (OEM) parts will be used where available and cost-effective
- Compatible third-party parts may be used with your consent if OEM parts are unavailable
- Special order parts may require advance payment
3.4 Repair Timeframes
Estimated repair timeframes are provided for guidance only. While we strive to complete repairs within the estimated time, we do not guarantee specific completion dates. Factors affecting timeframe include:
- Availability of replacement parts
- Complexity of the repair
- Queue of devices awaiting service
- Unforeseen technical complications
4. Data & Software
Critical Warning: The Company is not responsible for data loss during repairs. This includes but is not limited to: photos, videos, documents, contacts, messages, applications, and settings.
4.1 Data Backup Responsibility
Customers are strongly advised to back up all data before submitting devices for repair. We recommend:
- Creating a full backup to external storage or cloud services
- Recording or exporting important passwords and credentials
- Documenting software licenses and activation keys
- Removing or encrypting sensitive personal information if possible
4.2 Data Access
Our technicians may need to access your device to:
- Verify functionality after repair
- Diagnose software-related issues
- Test features and components
We respect your privacy and will only access data necessary for the repair process. We do not browse through personal files, photos, or messages unless specifically required for diagnostics.
4.3 Software and Operating Systems
- Software updates or reinstallation may be necessary for certain repairs
- We are not responsible for loss of software, applications, or licenses
- Operating system reinstallation may result in data loss
- We do not provide software licensing or cracked software
4.4 Passwords and Access
If you provide passwords or access codes:
- This information is stored securely and only used for repair purposes
- We recommend changing passwords after service completion
- We are not responsible for unauthorized access if you fail to change passwords
5. Warranty
5.1 Warranty Coverage
All repairs carry a warranty covering only the specific repair performed. The warranty period is:
- Hardware Repairs: 90 days from date of collection
- Software Repairs: 30 days from date of collection
- Replacement Parts: As per manufacturer warranty (minimum 90 days)
5.2 What Warranty Covers
The warranty covers:
- Defects in workmanship related to the specific repair performed
- Failure of replacement parts under normal use
- Reoccurrence of the original fault (if not caused by customer misuse)
5.3 What Warranty Does NOT Cover
Exclusions: Warranty does not cover physical damage, liquid damage, or misuse occurring after the repair is completed.
Specifically, warranty is void if:
- The device is subjected to physical damage (drops, impacts, crushing)
- Liquid damage occurs (water, moisture, spills)
- Unauthorized third parties attempt repairs
- The device is modified or tampered with
- Damage results from use of incompatible accessories or chargers
- Software issues unrelated to the original repair
- Damage from power surges, electrical storms, or improper power supply
- Normal wear and tear
5.4 Warranty Claims
To make a warranty claim:
- Contact us within the warranty period
- Provide proof of repair (invoice or receipt)
- Describe the issue in detail
- Bring or send the device for assessment
If the issue is covered under warranty, we will repair or replace the defective component at no additional cost. If the issue is not covered, a quotation will be provided for the necessary repairs.
6. Uncollected Devices
Abandoned Property: Devices not collected within specified timeframes may be considered abandoned and disposed of according to these terms.
6.1 Storage Period
After we notify you that your device is ready for collection:
- 0-30 days: No storage fees. Device held securely.
- 31-90 days: Storage fees may apply at R50 per day or part thereof.
- After 90 days: Device may be disposed of to recover costs.
6.2 Notification
We will make reasonable attempts to contact you using the contact information provided:
- Notification when device is ready for collection
- Reminder at 30 days if uncollected
- Final notice at 60 days warning of impending disposal
6.3 Disposal
Devices uncollected after 90 days may be:
- Sold to recover repair and storage costs
- Recycled for parts
- Disposed of in an environmentally responsible manner
Any proceeds from disposal will first be applied to outstanding costs. Any surplus will be held for 12 months, after which it will be forfeited to the Company.
6.4 Exception for High-Value Items
For devices with a value exceeding R10,000, we will hold the device for 180 days before disposal, provided storage fees are paid or arrangements are made.
7. Payment Terms
7.1 Payment Due
Payment is due in full before device collection unless prior credit arrangements have been made in writing.
7.2 Accepted Payment Methods
- Cash
- Credit/Debit Cards (Visa, Mastercard)
- Electronic Funds Transfer (EFT)
- Instant EFT (Ozow, PayFast)
7.3 Late Payment
If payment is not received within 7 days of repair completion:
- Storage fees may apply
- The device will not be released until full payment is received
- We reserve the right to exercise our rights under Section 6 (Uncollected Devices)
7.4 Refunds
Refunds are provided only in the following circumstances:
- We are unable to complete the agreed repair through no fault of the customer
- The repair fails within the warranty period and we cannot rectify it
- Overpayment or billing errors
Refunds will be processed within 14 business days to the original payment method.
8. Limitation of Liability
8.1 Pre-existing Damage
We will document the condition of your device upon receipt. However, we are not liable for:
- Pre-existing damage not identified during initial inspection
- Cosmetic damage that does not affect functionality
- Issues arising from manufacturing defects unrelated to our repair
8.2 Consequential Damages
We are not liable for:
- Loss of profits, revenue, or business opportunities
- Loss of data or software
- Damage to reputation or goodwill
- Any indirect, incidental, special, or consequential damages
8.3 Maximum Liability
Our total liability for any claim arising from repair services shall not exceed the amount paid for the specific repair service giving rise to the claim, or the replacement value of the device, whichever is less.
9. Governing Law
These Repair Terms are governed by and construed in accordance with the laws of the Republic of South Africa.
Any dispute arising from these terms shall be subject to the dispute resolution procedures outlined in our general Terms of Service.
Nothing in these terms affects your statutory rights as a consumer under the Consumer Protection Act 68 of 2008.
